Data processing terms

Effective 6 September 2026. These terms apply when instanceof.ai processes personal data on behalf of a customer. A countersigned copy is available on request.
Roles
For business content, form responses, bookings, customer conversations and meeting records in your workspace, you are the controller and instanceof.ai is the processor. We process that data only to provide the service and only on your documented instructions, which include your use of the product's own settings.
For your account and billing records we are the controller.
Subject matter and duration
We process workspace data for as long as your workspace exists, subject to the retention settings available for each resource. Processing ends when you delete the data or the workspace, or when the agreement ends.
Categories of data and data subjects
Business page content, form answers and attachments, booking details, chat messages, voice recordings, transcripts, names, email addresses and calendar metadata, belonging to you, your colleagues, visitors, respondents, invitees and the people you meet with.
Our obligations
- Process only on your instructions, and tell you if we believe an instruction breaks the law.
- Keep everyone with access under a duty of confidentiality.
- Apply the security measures described in the privacy policy.
- Engage subprocessors only under equivalent terms, with notice before any addition.
- Help you answer a data subject's request, and support your impact assessments.
- Notify you without undue delay after becoming aware of a personal data breach.
- Delete or return the data at the end of the agreement.
- Make available what you need to demonstrate compliance, and allow an audit on reasonable notice.
Subprocessors
The current list is published in the privacy policy and is the complete one.
International transfers
Data is stored in Brazil. Some subprocessors process data outside Brazil and the European Economic Area; those transfers rely on Standard Contractual Clauses or an adequacy decision.
