Terms of service

Effective 6 September 2026. These terms govern your use of the hosted instanceof.ai service. If you need signed terms, write to hello@instanceof.ai.

The service

instanceof.ai provides business pages, forms, scheduling and webchat operated through your workspace dashboard or an authorized agent. Optional meeting features record, transcribe and summarize meetings you send them to. Hosted agent features may be offered separately as a pilot. You get it as a hosted service; you are not licensed to copy, host or resell the software behind it.

Your account

You are responsible for what happens under your account and for keeping your API keys secret. A key can be revoked at any time from the dashboard. Do not share one account between people who should not see each other's meetings; invite them to the workspace instead.

Your content

Your pages, form responses, booking details, chat messages, meetings, recordings, transcripts and notes are yours. You grant us only the permission needed to run the service for you: to store them, to process them, and to send them to the subprocessors named in the privacy policy. We do not use your content to train models.

You are responsible for having the right to record the meetings you send the bot to, and for obtaining consent where the law or the room requires it. The bot names itself in the participant list and posts a recording notice by default; turning those off is your decision and your risk.

Plans, billing and usage

Agent plans are monthly subscriptions in USD for one company’s workspace. An agent seat is a managed agent identity, not a person, conversation or individual MCP request. Additional seats, business profiles, responses, storage and recording allowances are listed in the offer you review before checkout. Business profiles share their workspace and are not isolated client accounts. Existing Solo and Studio contracts retain their original currency and agreed conditions until an explicit change.

Processing credits apply to the hosted processing identified in your offer, not to calls made by your own agent through MCP. Included monthly credits expire at the end of their subscription period and do not roll over. Purchased credit packs are separate one time purchases with no automatic renewal or expiry. They are usable only for the supported processing shown before purchase, are not money and cannot be transferred or redeemed for cash. Statutory refund rights are not affected. Refunds or disputes may freeze the associated balance while the payment is reviewed.

There are no automatic top ups or overage charges. When a processing balance or agent budget is insufficient, new paid processing pauses. Your saved data remains subject to the workspace’s retention and subscription conditions. Canceling a subscription does not automatically refund a separate credit purchase. Freemium remains unavailable. Pilot credits are promotional test capacity, not a payment. Features and checkout configurations that are not yet available cannot be purchased through the dashboard.

Creem processes payments as merchant of record. The final price, billing interval, taxes and payment terms are shown before you confirm a purchase.

Open Plan and usage in your workspace to access the billing portal and cancel. Cancel at any time and the plan runs to the end of the period you paid for. We will not bill you again after that.

Refunds

If something is wrong with your purchase, contact hello@instanceof.ai. We review refund requests promptly and in accordance with applicable law and Creem's buyer terms. Approved refunds are processed by Creem to the original payment method.

Availability

We aim for high availability and we do not promise perfection. The bot depends on third-party meeting platforms that change without notice; when a platform breaks the bot, we fix it as fast as we can. Paid plans that need a formal uptime commitment should ask for one.

Ending it

You can request permanent workspace deletion from Settings. Deletion cancels the associated subscription immediately before erasing the database and files. It does not automatically issue a refund. Pending payments or unverified cancellation must be reconciled first; the workspace is preserved until billing can be checked. Contact support if an earlier payment provider requires manual reconciliation.

We may suspend an account that is being used to break the law, to record people unlawfully, or to attack the service. We will tell you why.

Liability

The service is provided as it is. To the extent the law allows, our liability is limited to the amount you paid in the twelve months before the claim. Nothing here limits liability that cannot be limited.

New shared usage contracts provide one monthly balance for supported agent processing, accepted form responses and meeting processing at the rates shown before purchase. Examples are alternative uses of the same balance, not independent allowances. External MCP calls are not charged a second time for the underlying operation. Storage, channel budgets and concurrency have separate limits. Recording duration is reserved before joining; the bot leaves at that limit. Historical credit packs keep their original service terms.

YouTube

If you use the YouTube feature, you agree to be bound by the YouTube Terms of Service. Before an upload can be sent, the person reviewing that exact video must certify that it complies with the YouTube Community Guidelines. You remain responsible for the video, its title, description, visibility and audience setting.
